  • Is the Data Secure on the hard drives, CD’s, DVD’s if it were to be lost?  Fall into the wrong hands?

  • Who and How is your data being transported?   

  • Who will be there to receive it?    Where and How will it be secured?

  • Who will have access to it?    Do you get to prior approve any/all eyes that see your information?

  • Will any copies be made?   How do you keep track of these?

  • Will it be loaded to a server / SAN?      Is this a shared resource or 100% dedicated to your matter?

  • How is that data physically partitioned and protected from other data?

  • Is the data processed in a production area with other projects?

  • Who has access to data/machines while data is being processed?

  • Are Cameras, phones, thumb drives allowed on the production floor, server room?

  • How is the data secured so that it cannot be copied or emailed?

  • Is real time surveillance video of the production floor and server rooms available?  Stored?  Streamed?

  • Are armed guards on duty 7×24x365?   Are there trackbacks to everyone and anyone who saw or touched your data?

  • How would you know if there were an incident involving your data, documents, emails?

As your mind starts to cycle thru all of the potential gaps and areas that need to be guarded against,  you will understand why what and how we conduct data preservation and electronic discovery is so important if the data is important.   Only you can determine the risk,  We make sure it doesn’t become an issue.

 

Even before you start down the path of letting anyone see or touch your data you should run a full early case assessment to memorialize what you have and to create complete reports.
